General Rule: Immunity
Colorado government entities are generally immune from lawsuit. The CGIA provides specific waivers of this immunity for certain categories of claims.
Waivers of Immunity
- Motor vehicles: Claims arising from government employee operation of motor vehicles
- Highways: Dangerous conditions of public highways, roads, and streets
- Buildings: Dangerous conditions of public buildings
- Hospitals: Dangerous conditions of public hospitals and healthcare facilities
CGIA Caps (C.R.S. § 24-10-114)
- $400,000 per person per occurrence
- $1,000,000 per occurrence (aggregate)
These caps are separate from and generally lower than the standard PI damage caps.
